General Terms and Conditions
1.) Scope of Application
1.1. These General Terms and Conditions (GTC) in their current version exclusively apply to the business relationships between the Ski School Ehrwald (hereinafter referred to as “Ski School”) and the contractual partner (hereinafter referred to as “Customer”). The applicable version of the GTC is determined by the time of the Customer’s submission of the relevant offer.
1.2. The Ski School provides services to the Customer in the area of skiing and snow sports. These services include, among other things, the provision of ski, snowboard, and cross-country skiing lessons (in accordance with § 1 Para. 1 T-SSG 1995), as well as related activities (hereinafter referred to as “Courses”). These services also encompass any childcare services and related activities (e.g., catering for children). These GTC apply to all services provided by the Ski School in this context.
1.3. Any provisions deviating from these GTC are only valid if expressly agreed upon in writing between the Ski School and the Customer. The Customer’s conflicting terms and conditions have no effect on the business relationships referred to in Point 1.2.
2.) Conclusion of Contract
2.1. A contract between the Ski School and the Customer can be concluded electronically (via email or online shop) or in the Ski School’s premises (contract conclusion by handing over a payment receipt).
2.2. The submission of a fully completed online form by the Customer constitutes a legally binding offer to the Ski School to conclude a contract for the services offered by the Ski School. The Ski School will send an order confirmation to the Customer based on such an offer. The contractual relationship between the Ski School and the Customer is established only upon the transmission of this order confirmation.
2.3. The Ski School is not obligated to inform the Customer of the rejection of online bookings. If the Customer’s offer is not confirmed by the Ski School within 48 hours of receipt, the Customer’s offer is considered not accepted.
3.) Right of Withdrawal
3.1. The Customer is entitled to unilaterally withdraw from the contract under the following conditions in writing (email is sufficient) without further obligations, particularly without the obligation to pay a fee, in compliance with the cancellation conditions (cancellation only possible in writing) as follows:
• 21 days before arrival / free of charge
• 20 daysbeforearrival / 50% cancellationfee
• 10 daysbeforearrival / 100% cancellationfee
3.2. Change of Course Location / No right of withdrawal
The skicourses offered by the skischool generally take place in the area of the Wetterstein cablecars in the village. However, the skischool expressly reserves the right to relocate the course location to another ski area for organisational, weather-related, safety-related, or snow-related reasons.
In particular, holding the ski courses on the Ehrwalder Alm or on the Zugspitze shall be deemed performance in accordance with the contract, even if the Wetterstein cablecars in the village were originally intended as the course area.
In such cases, withdrawal from the contract, free cancellation, or a refund of the course fee is excluded, provided that the ski course is carried out as booked.
3.3. Every booking change must be reported exclusively at the ski school office (Kirchplatz 12) BEFORE the course begins, NOT to ski instructors or at the Confetti Alm!If participation in the booked service is not possible due to illness or accident, the customer may withdraw from the contract upon presentation of a medical certificate (on the same day, cancellation before 6 PM at the ski school office) from the moment the inability to participate occurs. The customer can choose to receive either a credit for the proportional amount to be refunded or a reimbursement of the proportional amount in cash (only if paid in cash at the office) or to the bank card used for payment at the office.
3.3. In all other cases, the Customer is not entitled to withdraw without the express written consent of the Ski School and must pay the full fee. This particularly applies to cases of no-shows or late arrivals for the agreed appointment.
3.5. The Ski School is entitled to withdraw from the contract at any time if the Customer participates under the influence of alcohol, drugs, or medication that no longer ensures safe participation. The same applies if the Customer persistently disobeys the instructions of the Ski School, the instructors, or the supervisors. The Customer has no claims in the event of such contract termination and is particularly obligated to pay the full fee.
4.) Prices, Payment Terms, Services
4.1. All information, particularly the ski school’s price lists available online, in brochures, advertisements, or other media, is non-binding for the ski school. The ski school reserves the right to make changes at any time.
4.2. All price information is in EURO (€) and is inclusive of any applicable statutory VAT.
4.3. Costs for ski tickets or equipment are not included in the course fees. These must be purchased and brought by the customer at their own expense.
4.4. The ski school’s claim to payment arises upon the conclusion of the contract. If booked in advance, the course fee can be paid within 14 days of the conclusion of the contract by bank transfer to the ski school’s account or in cash on-site. However, payment must be received by the ski school before the start of the course. All costs, particularly bank fees associated with the payment of the booked course, are solely the responsibility of the customer.
4.5. The customer is considered in default of payment without further notice from the ski school. If the customer falls behind on a payment, the ski school is entitled to charge the statutory default interest and all additional costs and expenses incurred, especially collection or legal fees.
5. Participation Requirements
5.1. The customer must provide the ski school with truthful and comprehensive information about their skills and experience in the booked snow sports discipline and ensure that their equipment is suitable for the current level of ski/snowboard technology and external conditions. The customer must inform the ski school of any health issues or impairments.
5.2. The customer agrees not to participate in the course if they have a feverish infection, contagious disease, or illnesses accompanied by diarrhea and vomiting. In particular, the customer agrees not to attend the ski course if they exhibit COVID-19 symptoms (fever, dry cough, fatigue, breathing difficulties, etc.).
5.3. Before the start of the course, the customer is independently responsible for ensuring their ski equipment (especially ski bindings) is checked by a professional service provider.
5.4. The customer must follow the instructions of the ski school, the instructors, and the supervisors. Disregarding instructions and warnings entitles the ski school to terminate the contract immediately.
6.) Limitation of Liability
6.1. The ski school does not guarantee the success of the participants’ training in connection with the offered courses.
6.2. The ski school is not liable for damages unless the damages are due to intentional or grossly negligent behavior by the ski school or a person attributable to it, and the behavior causing the damage does not affect the main obligations arising from the concluded contract.
6.3. The ski school is not liable for damages the customer causes to themselves or others during the agreed services unless the ski school is at fault.
6.4. Regardless of fault, the ski school is not liable for lost profits, pure financial losses, or consequential damages that exceed three times the service fee.
6.5. The customer is informed that failure to wear a helmet may contribute to their negligence in the event of injury. Therefore, the customer is advised to wear a helmet and other recommended safety equipment (e.g., avalanche transceiver for off-piste skiing) for the booked service. Helmets and safety equipment generally reduce the risk of injury.
6.6. It is expressly stated that snow sports involve many risks, especially during tours or descents in off-piste areas, where there is an increased risk of injury or even death, particularly due to avalanches, which cannot be entirely excluded.
6.7. The customer acknowledges that rescue operations from slopes or off-piste areas are often associated with high costs. The customer is therefore advised to take out appropriate insurance, as the ski school does not cover rescue or air rescue costs unless the ski school or a person attributable to it has caused these costs through intentional or grossly negligent behavior.

8.) Content of the Online Offer
The ski school (hereinafter referred to as “the Author”) assumes no liability for the timeliness, accuracy, completeness, or quality of the information provided. Liability claims against the Author related to material or immaterial damages caused by the use or non-use of the information provided or by the use of incorrect or incomplete information are generally excluded unless the Author is proven to have acted with intent or gross negligence.
9.) Copyright and Trademark Law
The Author endeavors to respect the copyright of the graphics, sound documents, video sequences, and texts used in all publications, to use graphics, sound documents, video sequences, and texts created by the Author themselves, or to use license-free graphics, sound documents, video sequences, and texts.
All brand names and trademarks mentioned within the online offer and, if applicable, protected by third parties are subject without restriction to the provisions of the applicable trademark law and the ownership rights of the respective registered owners. The mere mention of trademarks does not imply that they are not protected by third-party rights!
The copyright for published objects created by the Author remains solely with the Author. Reproduction or use of such graphics, sound documents, video sequences, and texts in other electronic or printed publications is not permitted without the Author’s express consent.
10.) References and Links
For direct or indirect references to external websites (“links”) that lie outside the Author’s area of responsibility, liability would only arise if the Author had knowledge of the content and it was technically possible and reasonable to prevent the use of illegal content.
The Author hereby expressly declares that, at the time the links were set, no illegal content was recognizable on the linked pages. The Author has no influence on the current and future design, content, or authorship of the linked/connected pages. Therefore, the Author expressly distances themselves from all content of all linked/connected pages that were changed after the link was set. This statement applies to all links and references within the Author’s own online offer, as well as to third-party entries in guest books, discussion forums, and mailing lists set up by the Author.
The provider of the site referred to is solely liable for illegal, incorrect, or incomplete content and, in particular, for damages resulting from the use or non-use of such information, not the one who merely refers to the publication via links.
11.) Jurisdiction, Place of Performance, and Governing Law
The place of performance is the central business location of the ski school/ski rental. For disputes, the court responsible for the central business location of the ski school/ski rental has jurisdiction. Austrian law applies. The contract language is German.
Important information for your booking:
• If a group is reduced to less than the minimum number of three children, we reserve the right to shorten the lessons/days or to merge groups.
• Multiple changes of teacher possible due to the flexible organization.
• For each change to the booking (postponement/rebooking) we charge € 15 each
• We disclaim any liability for accidents that occur during or before ski lessons. Accident and liability insurance is the responsibility of the course participants.
• Price refund due to injury or illness only with medical confirmation. Only unused days (difference) will be refunded.
• Course cancellations due to weather-related influences (force majeure) will not be replaced. Private courses take place in all weathers. The course ticket is not transferable! Unused course days expire!
• All deliveries and services of the ski school based on online orders via the Internet or other online services are based on these terms and conditions.
• All offers are subject to change and non-binding. The author expressly reserves the right to change, supplement or delete parts of the pages or the entire offer without separate announcement or to cease publication temporarily or permanently.
